Judge decides indictment against West should stand | Crime and Courts

QUEENSBURY — Warren County Judge John Hall has denied a defense request to throw out the homicide indictment against Lake George boat crash defendant Alexander M. West, and he indicated he may consider allowing prosecutors to use blood test results that showed West used drugs.

In a 13-page ruling filed Tuesday, Hall directed West’s counsel and the Warren County District Attorney’s Office to argue the “possible admissibility of the blood test results due to the defendant’s consent.” He directed they file legal memoranda by March 17 before he determines whether to hold a hearing on the issue.

The judge set trial to begin April 17, with pre-trial hearings April 11 and a pre-trial conference April 14.
